Terms of Service
These terms are an agreement between you and [Company legal name] ("we", "us") for SignalHaul. By creating an account or using the service you agree to them, to the Acceptable Use Policy and to the Privacy Policy. If you sign up for a business, you confirm you can bind it.
The service
SignalHaul is software for dispatch businesses: it imports public FMCSA carrier records as leads, provides a browser softphone that works through your own Telnyx or Twilio account, vetting aids, an e-signature tool for your own dispatch agreement, and carrier onboarding. We may change features, and we will tell you about changes that materially reduce what your plan includes.
Accounts and plans
- Keep your login secret and your account details accurate. You are responsible for what happens under your account and for your teammates.
- Plans, prices and limits are shown on the pricing page. Every new workspace gets a 14-day free trial without a card. When it ends you pick a plan or enter an access code to keep working; your data stays in your workspace.
- Paid plans renew each month or year until cancelled. Fees are charged through our payment processor. Taxes may apply.
- Phone numbers and minutes are billed to you by your own telephony provider, not by us, and that provider's terms apply to you.
You are responsible for how you contact people
You decide who you call and what you say. You are responsible for complying with all laws that apply to your outreach, including the Telephone Consumer Protection Act, the FCC and FTC telemarketing rules, the National Do-Not-Call Registry and state do-not-call lists, state calling-hour and call-frequency limits (some states are stricter than the product's default calling window), caller-ID rules, and call-recording consent laws. The product includes safeguards, such as a calling-window guard and a recording notice, but they do not make a call lawful and are not legal advice.
Your data and ours
You keep ownership of your workspace data, including your leads, notes, agreements and recordings. You give us the right to host and process it to provide the service. Public FMCSA data belongs to its source and is provided as is. We keep the software and its content.
E-signatures
We provide a tool for you to send documents for electronic signature under the federal ESIGN Act and state UETA laws, and we keep an audit trail of sending, viewing and signing. The content of the agreement is yours: we do not provide legal advice and are not a party to your agreement with a carrier. Have a lawyer review your template.
Acceptable use
You agree not to break the law with the service, to follow the Acceptable Use Policy, and not to attack, resell or reverse-engineer it.
Availability and support
We work to keep the service available but do not promise it will be uninterrupted or error-free. Support is by email at support@signalhaul.com.
Warranty disclaimer and limits
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND TO THE EXTENT THE LAW ALLOWS. WE DO NOT PROMISE ANY INCOME, CARRIERS OR RESULTS. TO THE EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE FEES YOU PAID US IN THE 12 MONTHS BEFORE IT AROSE, AND WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. [Lawyer to confirm these limits.]
Ending the agreement
You can cancel any time from Billing. We may suspend or end accounts that break these terms or the law. After an account ends you can ask for an export of your data for a reasonable period, and then we delete it as described in the Privacy Policy.
Governing law and changes
These terms are governed by the laws of [State], without regard to conflict-of-law rules. [Venue and dispute resolution to be set by counsel.] We may update these terms and will post the new version with its date; continuing to use the service after a change means you accept it.
